What if CAs give our digital certs to the NSA? |

NSA has co-located sniffing hardware/software at AT&T (and other) telecom sites. It is capturing our data in bulk, for long-term storage, and eventual decryption.
In the past, we all presumed that a court-order for your data would be presented to the source of the data - your organization. This is not the case here.
In the current scenario, NSA goes to FISA court, and gets a secret court-order requiring Thwart of Verisign or ... to provide your certs. You/your organization will not know this is taking place. Your organization will not know when/if its data is being decrypted, and given to other 3rd parties (think IRS).
Did you bring this to the attention of your management? Do you intend to? If not, why not? _________________ I like deadlines. I like to wave as they pass by.

Assuming it traverses a USA-based network?

I believe most governments have a get-out-of-jail-free card in that respect, i.e. sharing 'intelligence' between departments.

The Eu, as an organisation, takes data protection very seriously - although I wonder how serious they are about being able to read it themselves... _________________ It's puzzling, I don't think I've ever seen anything quite like this before...and it's hard to soar like an eagle when you're surrounded by turkeys. |

No, because most of my management have trouble even spelling SSL & will not understand the issue except at the political level.

...as others have said, if the government obtains a court order (from an open or a secret court) then they're going to get the data anyway because we're going to give it to them. Or any provider with wire-sniffing technology is going to give it to them.

It is the case here. It's just that the court is not what you envisage when you frame the concept, it's a judge in a windowless office under the NSA but it is a judge. All governments play by the rules by definition because they make the rules.
