Sorry to contradict you....
SSL_RSA_WITH_AES_256_CBC_SHA + SSLFIPS is equivalent to TLS_RSA_WITH_AES_256_CBC_SHA (IIRC)... It only works if you set the SSLFIPS flag...

And before I forget, to use SSLFIPS the minimum key size should be 2048...
